Welcome to Shop Bamboo, the online store operated in connection with Bamboo Spa & Nails SF. These Terms of Service govern your access to and use of our online store, website, products, content, features, tools, communications, and related services offered through store.bamboospasf.com.

By visiting our online store, creating an account, placing an order, purchasing a product or gift card, signing up for communications, or otherwise using the store, you agree to these Terms of Service. Please read them carefully. If you do not agree, you should not use the online store.

Our online store is powered by Shopify. Shopify provides the ecommerce platform that allows us to offer products, process orders, manage checkout, support payment processing, and provide related online shopping functions.

1. Online Store; Separate In-Person Services

These Terms apply to online store activity, including browsing, product purchases, gift-card purchases, customer accounts, online promotions, online communications, returns, refunds, and related ecommerce activity.

These Terms do not replace any separate policies, waivers, intake forms, appointment rules, cancellation terms, booking-platform terms, or service-specific conditions that may apply to in-person spa, nail, massage, facial, waxing, lash, brow, or other services offered by Bamboo Spa & Nails SF, Bamboo Nails, Bamboo Massage, or related service locations.

If you book or receive an in-person service, that appointment or service may be subject to separate terms provided at the time of booking or service.

2. Eligibility and Account Responsibility

You must be at least the age of majority in your jurisdiction, or have the consent and supervision of a parent or legal guardian, to use this online store.

If you create an account, you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to update it as needed. We may refuse, suspend, or terminate an account if we believe the account information is inaccurate, fraudulent, abusive, or otherwise violates these Terms.

3. Products, Product Descriptions, and Availability

We do our best to present products accurately, including descriptions, images, ingredients when available, pricing, and availability. However, product images, packaging, colors, sizes, ingredients, and descriptions may vary from the actual product due to supplier updates, photography, screen display differences, or third-party catalog information.

Some products may be supplied, fulfilled, or shipped by third-party vendors, wholesalers, dropship suppliers, or brand partners. Product availability may change without notice. We reserve the right to limit quantities, discontinue products, correct errors, or refuse orders where permitted by law.

Product descriptions are provided for general informational and shopping purposes. Beauty, nail care, skincare, body care, wellness, and personal-care products are not intended to diagnose, treat, cure, or prevent any medical condition unless expressly stated by the manufacturer and permitted by law. You should review product labels, ingredients, warnings, and instructions before use.

4. Ingredients, Allergies, and Product Sensitivities

Personal-care products may contain ingredients that cause irritation, allergic reaction, sensitivity, or other unwanted effects for some individuals. You are responsible for reviewing ingredient lists, directions, warnings, and product labels before use.

If you have allergies, sensitive skin, medical conditions, are pregnant or nursing, use medications, or have concerns about a product, consult an appropriate professional before use. Stop using any product if irritation or discomfort occurs. Bamboo is not responsible for misuse of products or failure to follow product instructions, warnings, or labels.

5. Orders and Acceptance

Placing an order does not guarantee acceptance. We may accept, decline, cancel, or limit an order where permitted by law, including where a product is unavailable, the order appears fraudulent or abusive, payment cannot be processed, shipping information is incomplete, pricing or product information contains an error, or fulfillment is not available to the destination provided.

If we cancel an order after payment has been processed, we will issue a refund for the canceled portion of the order to the original payment method, unless otherwise required by law.

6. Prices, Payment, and Taxes

Prices are listed in U.S. dollars unless otherwise stated. Prices, promotions, and availability may change without notice. We reserve the right to correct pricing or product errors, subject to applicable law.

You agree to provide valid payment information and authorize us, Shopify, and our payment processors to charge your selected payment method for the total amount of your order, including applicable taxes, shipping, handling, and other charges disclosed at checkout.

Sales tax and other applicable taxes may be calculated at checkout based on the shipping address, billing information, product type, or other legally relevant factors.

7. Shipping and Delivery

Shipping options, rates, estimated delivery dates, and available destinations may be shown at checkout. Delivery estimates are not guarantees. Shipping may be performed by Bamboo, Shopify-supported services, suppliers, dropship vendors, fulfillment partners, or shipping carriers.

Once an order is transferred to a carrier or fulfillment provider, delays may occur due to carrier operations, weather, address issues, supply constraints, or other events outside our control. You are responsible for providing accurate shipping information. We are not responsible for delays or failed deliveries caused by incorrect or incomplete addresses.

Risk of loss may pass to you when the order is delivered to the carrier, except where applicable law provides otherwise or where we expressly assume responsibility.

8. Returns and Refunds

Returns and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms by reference.

For hygiene and safety reasons, opened, used, tested, altered, or unsealed beauty, wellness, nail care, skincare, body care, cosmetic, tool, applicator, or personal-care products may not be eligible for return unless required by law or unless the product arrived damaged, defective, or incorrect.

9. Gift Cards

Gift cards may be used according to the terms disclosed at purchase and any applicable store or service policies. Gift cards are not redeemable for cash except as required by law.

Under California law, gift cards with a remaining balance of less than $10 may generally be redeemable for cash upon request. Gift cards generally may not expire or carry service fees except as permitted by law.

Gift cards should be treated like cash. Bamboo is not responsible for lost, stolen, damaged, or unauthorized use of gift cards, except where required by law.

10. Promotions, Discounts, and Offers

Promotions, discount codes, bundles, free-shipping offers, gifts with purchase, or other offers may be subject to separate terms, eligibility limits, expiration dates, product exclusions, quantity limits, or geographic restrictions.

Promotions may not be combined unless expressly stated. We may modify or end promotions at any time, subject to applicable law. If a promotion contains an error, we reserve the right to correct the error or cancel affected orders where permitted by law.

11. No Automatic Renewal Unless Clearly Disclosed

We do not intend to enroll customers in automatic renewal, subscription, or recurring-payment programs unless the terms are clearly and conspicuously disclosed before purchase and the customer affirmatively consents. California imposes specific requirements for automatic renewal and continuous-service offers, including clear disclosure, affirmative consent, acknowledgment terms, and cancellation rights. The California automatic-renewal statute is generally reflected in Business and Professions Code sections 17600 through 17606.

If Bamboo later offers subscriptions, memberships, recurring shipments, or automatic renewals through the online store, additional terms will apply and will be presented at or before checkout.

12. User Content, Reviews, and Communications

If you submit reviews, comments, photos, feedback, suggestions, messages, or other content to us or through the online store, you represent that you have the right to submit that content and that it does not violate the rights of others.

You grant Bamboo a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, edit, and distribute content you submit for purposes related to operating, marketing, improving, and promoting the store and Bamboo’s products and services, subject to applicable law and our Privacy Policy.

We may remove or decline to publish content that is false, misleading, abusive, obscene, discriminatory, unlawful, infringing, spam, irrelevant, or otherwise inconsistent with our brand or legal obligations.

13. Prohibited Uses

You agree not to use the online store for any unlawful, harmful, fraudulent, abusive, or unauthorized purpose. You may not interfere with store security or functionality, scrape or copy content in violation of these Terms, impersonate another person, submit false information, attempt unauthorized access, misuse discount codes or promotions, engage in chargeback abuse, upload malicious code, or use the store in a way that violates applicable law or the rights of others.

We may suspend or restrict access, cancel orders, refuse service, or take other appropriate action if we believe these Terms have been violated.

14. Intellectual Property

The online store, including its design, text, graphics, logos, product presentation, photography, images, layout, icons, videos, content, and other materials, is owned by Bamboo, Shopify, suppliers, licensors, or other rights holders and is protected by intellectual property laws.

You may use the store for personal, non-commercial shopping purposes only. You may not copy, reproduce, distribute, modify, sell, exploit, or use store content for commercial purposes without permission.

Brand names, supplier names, third-party product names, and trademarks belong to their respective owners. References to third-party brands do not necessarily imply endorsement, sponsorship, or affiliation unless expressly stated.

Our collection, use, disclosure, and processing of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

By using the online store, you acknowledge that your information may be processed by Bamboo, Shopify, payment processors, fulfillment providers, shipping carriers, service providers, and other parties as described in the Privacy Policy.

16. Third-Party Tools, Links, and Services

The online store may include links to third-party websites, payment tools, social media platforms, booking platforms, product suppliers, shipping carriers, or other services. These third-party services are not controlled by Bamboo.

Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party content, policies, practices, errors, delays, outages, or services.

17. Disclaimer of Warranties

The online store and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Bamboo disclaims warranties that the store will be uninterrupted, error-free, secure, or free from harmful components.

Products may be subject to manufacturer warranties, supplier warranties, or legally required warranties, if any. Nothing in these Terms is intended to limit rights you may have under applicable consumer-protection, product-liability, warranty, or other laws that cannot be waived.

18. Limitation of Liability

To the fullest extent permitted by law, Bamboo Spa & Nails SF, Shop Bamboo, and their owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the online store, products, third-party services, or these Terms.

To the fullest extent permitted by law, our total liability for a claim arising from an online store transaction will not exceed the amount you paid for the product or order giving rise to the claim.

These limitations do not apply where prohibited by law, including claims that cannot lawfully be limited or excluded under California or federal law.

19. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Bamboo Spa & Nails SF, Shop Bamboo, and their owners, employees, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, misuse of the online store, violation of law, infringement of another person’s rights, or submission of unlawful or infringing content.

This indemnification obligation will not apply to the extent a claim results from Bamboo’s own unlawful conduct, gross negligence, or willful misconduct.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law applies or where applicable consumer-protection law requires otherwise.

21. Dispute Resolution and Venue

Before filing a claim, you agree to contact us and give us a reasonable opportunity to resolve the issue informally. Many concerns can be resolved by contacting us directly.

Subject to applicable law, any dispute arising from or relating to these Terms, the online store, or an online purchase shall be brought in the state or federal courts located in San Francisco County, California, unless another venue is required by applicable consumer law.

Nothing in this section limits your right to bring a claim in small claims court where permitted by law or to pursue rights that cannot be waived under applicable law.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes in our store, products, technology, operations, law, or business practices. Updated Terms will be posted on the online store with a revised “Last updated” date.

Your continued use of the online store after updated Terms are posted means you accept the updated Terms, except where additional notice or consent is required by law.

23. Severability

If any part of these Terms is found invalid, unlawful, or unenforceable, that part will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
